(By Sri.H.Jayakarashetty, CGC) …Respondent This writ petition is filed under Articles 226 and 227 f the Constitution of India to quash the impugned order passed by the respondent dated 24/03/2018 ( Annexure- E) etc.
This petition coming on for preliminary hearing in ‘B’ Group this day, the Court made the following;
ORDER In the instant petition, petitioner has sought for quashing of the order of transfer dated 24/03/2018, by which, he has been transferred from BN 230 CRPF, Bacheli, Dantewada (Chattisgarh) to Kashmir BN 14. Feeling aggrieved and dissatisfied by the order of transfer dated 24/03/2018, petitioner has submitted a representation (Annexure-F) dated 27/03/2018 raising various issues including certain physical disability.
2. Having heard the learned counsel for the parties, the concerned authority is hereby directed to take note of the petitioner’s representation and its contents according to the provisions of The Persons with Disabilities (equal opportunities) Protection of Rights and Full Participation Act, 1995 and accommodate him at BN 230, if there is no administrative inconvenience.
3. At this stage, learned counsel for the petitioner submitted that the order of transfer dated 24/03/2018 has not been given effect even to this day. Therefore, the respondent need not take coercive steps in relieving petitioner till a decision is taken on the petitioner’s representation.
4. With the above direction, the petition stands disposed of.
