Sri Bal Mukand vs Prescribed Authority, ...

High Court Of Judicature at Allahabad|03 February, 2010

JUDGMENT / ORDER

Hon'ble Virendra Kumar Dixit,J.
Heard learned counsel for the petitioner.
From the perusal of the record it transpires that issues were framed on 5.10.1988 and the plaintiff's evidence has been concluded on 19.2.2008 and since then a number of dates were fixed for defendant evidence. The defendant is adopted delay tactics on one pretext or the other. As the suit is pending for the last 27 years and the case is lingering on account of the defendant evidence.
We direct the Civil Judge (Junior Division)/Prescribed Authority, Moradabad to give three weeks' more time to the defendant for leading the entire defence evidence. The learned court/opposite party no.1 is further directed to proceed with the matter expeditiously and decide the suit within a period of four months from the date a certified copy of this order is produced before him.
With the above observations/directions, the writ petition is finally disposed of.
Order Date :- 3.2.2010 sks
