ORDER:
The case of the petitioner is that his wife gifted the house bearing No.42-736/7 situated at Mussallam Jung Colony, Moulali, Hyderabad. They have been in possession of the said property since 2007. He applied for regularization under BPS introduced by the Government and he also paid requisite fee along with the said application. While the said application was pending consideration, the respondents issued notice dated 19.04.2008, to which, the petitioner submitted his explanation on 20.05.2008. However, no orders have been passed thereafter. When there was threat of demolition of the aforesaid said house, the present Writ Petition was filed.
Even after lapse of six years, no counter affidavit is filed by the respondents. However, having regard to the facts of the case, this Court is inclined to dispose of the Writ Petition directing the respondents to consider the explanation submitted by the petitioner on 20.05.2008 for the notice issued by the second respondent under Section 452 of the Hyderabad Municipal Corporation Act, 1955 and also application submitted under BPS on 30.04.2008 and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order.
The Writ Petition is accordingly disposed of. Consequently, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs.
