Heard learned counsel for the petitioners and learned Standing Counsel for respondents State.
It is contended that application for payment of gratuity has been moved by petitioner no. 1 in the year 2020 and by petitioner nos. 2 and 3 in the year 2021 before Labour Commissioner, Kanpur Nagar. The file has been marked for respondent no. 3 and the same is pending consideration before him.
The sole prayer is for early decision on the application filed for payment of gratuity.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the application.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 3 to decide the application of petitioner for payment of gratuity, if there are no legal impediments and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
