THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE R-2 DY.COMMISSIONER TO DISPOSE OF THE APPLICATION FILED BY THE PETITIONER UNDER RULE 119 OF THE KARNATAKA LAND REVENUE RULES 1966 AS AMENDED, VIDE ANNEX-J & S AND ETC.
THESE WRIT PETITIONS COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.V.Lakshminarayana, learned counsel for the petitioners.
Mr.Vijay Kumar A. Patil, learned counsel for respondent Nos.1 and 2.
Mr.B.K.Soodi, learned counsel for respondent Nos.3 and 4.
2. The writ petitions are admitted for hearing.
With consent of the learned counsel for the parties, the same are heard finally.
3. In these petitions, the petitioner inter alia seeks a direction to respondent No.2 to dispose of the application filed by the petitioner under Rule 119 of the Karnataka Land Revenue Rules, 1966.
4. When the matters were taken up today, learned counsel for the petitioners submitted that the writ petitions be disposed of with a direction to respondent No.2 to consider and decide the application submitted by a speaking order within a fixed time limit. On the other hand, learned Government Advocate submitted that in case such an application is pending, the same shall be dealt with in accordance with law.
5. In view of the submissions made and in facts of the case, petitions are disposed of with a liberty that in case such an application is still pending the same shall be dealt with in accordance with law by a speaking order within a period of two months from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petitions are disposed of.
