Orders of dismissal as affirmed in appeal and revision are challenged in this petition. Since various factual issues arises for determination in the facts of the present case, as such, Sri O.P. Singh, learned senior counsel, appearing for the petitioner, at the very outset, seeks leave of the Court to withdraw the writ petition with liberty to approach the Industrial Tribunal.
Prayer in that regard is not opposed by Sri Sanjai Singh, learned counsel for the respondent.
Writ petition accordingly is dismissed as not pressed with liberty to petitioner to approach the Industrial Tribunal for redressal of his grievance.
It is provided that in the event petitioner makes an appropriate application, his claim shall be referred to the competent forum, keeping in view the provisions contained under Section 2-A of the Industrial Disputes Act, 1947, expeditiously.
