THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT RESPONDENTS TO INCORPORATE THE CORRECT DATE OF BIRTH OF THE PETITIONE AS 17.12.1993 AND NOT AS STATED PRESENTLY IN THE PASSPORT BEARING NO. J0357141 DATED 30.04.2010 AT ANNEX-D.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN B GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.S.Venkatesh Naran for Sri.Narayana, learned counsel for the petitioner.
Mr.C.Shashikanth learned counsel for the respondent Nos.1 & 2.
2. The writ petition is admitted for hearing.
With consent of the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks a direction to the respondent to incorporate the correct date of birth of the petitioner, which according to the petitioner is 17.12.1993.
4. When the matter was taken up today, learned counsel for the petitioner submitted that he be granted the liberty to submit the representation in this regard to respondent No.2 viz., the Regional Passport Officer, Bengaluru and the aforesaid authority be directed to consider the representation, which may be submitted by the petitioner with regard to correction of the Date of Birth. On the other hand, learned counsel for the respondents submitted that in case such a representation is submitted along with the requisite documents, the same shall be dealt with in accordance with law.
5. In view of the submissions made and in the facts of the case, the writ petition is disposed of with a liberty to the petitioner that in case the petitioner submits a representation with in a period of two weeks from the date of receipt of the certified copy of the order passed today, the respondent No.2 shall decide the aforesaid representation by a speaking order within a period of six weeks therefrom after affording an opportunity of hearing to the petitioner. Based on the decision which may be taken, appropriate action shall be taken by respondent No.2 in accordance with law.
With the aforesaid direction, the petition stands disposed of.
