3. Sri. Mallikarjun Awati S/o Shivappa, Aged about 31 years, Occ: Assistant Lineman, BESCOM, Tyavangi Division, Santebenuru Sub-Division, Davangere – 577 002. …Petitioners (By Sri. Javeed .S, Advocate) AND:
1. The General Manager ADM & HRD, KPTCL, Corporate Office, Bengaluru – 560 009.
2. The Executive Engineer (EI) O & M, Jayanagara Division, Banasankari 2nd Stage, Bengaluru – 560 070.
3. The Executive Engineer (EI) VA, COM & PA Division, Davangere – 577 002. …Respondents (By Sri. G.C. Shanmukha, Advocate) These writ petitions are filed under Articles 226 and 227 of the Constitution of India, praying to quash order dated 28.06.2018 vide Annexures-Q and R and order dated 25.09.2018 produced as Annexure-S passed by respondent Nos.2 and 3 and etc., These writ petitions coming on for Preliminary Hearing this day, the court made the following:
ORDER In the instant petitions, petitioners have sought for the following reliefs:
(a) issue writ of certiorari or any other appropriate writ or order to quash order dated 28.06.2018 bearing No.Ka.Ni.Vi.Je.Vi.Ke.Asa/1531-36 & Ka.Ni.Vi.Je.Vi.Ke.Asa/1497-503 which is produced as Annexure-Q & R and order dated 25.09.2018 bearing No.Ka.Ni.Vi/Da./Le. Aa/HI.Sa(Saa)/14474-79 produced as Annexure-S, passed by the respondent No.2 & 3.
(b) Issue writ of mandamus directing the respondents to continue the services of the petitioners till the cases of the petitioners is considered in accordance with law;
(c) Pass any other appropriate writ or order or direction as this Hon’ble Court deems fit to grant in the circumstances of the case, in the interest of justice and equity.
2. Learned counsel for the petitioners submitted that in an identical matter, this Court has allowed the W.P. No.46307/2018.
3. Learned counsel for the respondents has not disputed the same.
4. Accordingly, petitions are allowed.
Annexures-Q, R and S are set aside in terms of the order passed in W.P. No.46307/2018 dated 19.06.2019.
