IN THE HIGH COURT OF KARNATAKA AT BENGALURU DATED THIS THE 21ST DAY OF FEBRUARY, 2019 BEFORE THE HON’BLE MR. L. NARAYANA SWAMY ACTING CHIEF JUSTICE MFA NO.2999 OF 2010 (MV) BETWEEN:
SRI AMEER S/O LATE MOHAMMED IMAM SAB AGED ABOUT 67 YEARS RESIDING AT DALASANUR VILLAGE SRINIVASPUR TALUK KOLAR DISTRICT.
(BY SRI J.G. KUMBAR, ADVOCATE) AND:
KARNATAKA STATE ROAD TRANSPORT CORPORATION REGIONAL OFFICE K.H. ROAD, SHANTHI NAGAR BANGALORE – 560 027 REP. BY ITS MANAGING DIRECTOR (BY SRI G.A.K. GOWDA, ADVOCATE) ---
... APPELLANT ... RESPONDENT THIS MFA IS FILED UNDER SECTION 173(1) OF MV ACT AGAINST THE JUDGMENT AND AWARD DATED 15.09.2009 PASSED IN MVC NO.2060/2008 ON THE FILE OF THE XIII ADDITIONAL SMALL CAUSE JUDGE AND COURT OF SMALL CAUSES-15, MEMBER, MACT, BANGALORE, DISMISSING THE PETITION FOR COMPENSATION.
THIS MFA COMING ON FOR HEARING THIS DAY, THE COURT DELIVERED THE FOLLOWING:
JUDGMENT The claim petition came to be dismissed on the ground that the claimant has not established the relationship with the deceased. Though he claims that name of the deceased has been referred to in Ex.P-8 - ration card, the case of the claimant has been disbelieved, against which this appeal is filed.
2. When this appeal is filed, the claimant at least should have produced any additional or cogent material to impress this Court in order to get it allowed or remanded for fresh consideration. But, no such effort has been made except relying on Ex.P-8.
3. No ground is made out for interference in the reasons assigned by the Tribunal in dismissing the claim petition.
Accordingly, the appeal is rejected.
