Rachaiah, HCGP for R1) This Criminal Petition is filed under Section 482 of Cr.P.C praying to quash the FIR in Cr.No.34/2017 for the offences punishable under Sections 153-A, 295-A of IPC and Section 66 of Information Technology Act, 2008 against the petitioner who is accused No.1 before the Principal Senior Civil Judge and J.M.F.C., Hunsur, Mysuru District by allowing the above petition and etc.
This Criminal Petition coming for Admission this day, the Court made the following:
O R D E R Learned counsel for petitioner files a memo dated 19/03/2019 stating that since ‘B’ Report has been filed against petitioner, prayer sought for in the petition has become infructuous. Memo is placed on record.
2. Accordingly, petition is dismissed as having become infructuous.
3. In the event the protest memo being filed by the complainant and same being accepted, petitioner would be at liberty to challenge the same in manner known to law and urge all grounds including the grounds urged in the present petition.
