VINOD KUMAR, AGA) **** THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ALLOW THE WRIT PETITION AND DIRECT THE RESPONDENT-2 NOT TO INTERFERE WITH CONSTRUCTION WORK IN THE SCHEDULE PROPERTY, WHICH IS UNDER TAKEN BY THE PETITIONER IN THE SCHEDULE PROPERTY.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R The petitioner in this writ petition has sought for the following reliefs:
a) Direct the 2nd respondent not to interfere with construction work in the schedule property which is undertaken by the petitioner in the schedule property.
b) Direct the 2nd respondent not to call or force the petitioner attend their Police Station unnecessarily without any reasons.
c) Grant such other relief or reliefs as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.
2. Sri M. Vinod Kumar, learned AGA on taking notice for Respondent Nos.1 and 2 and on instructions from Respondent No.2 submits that the Police never interfered and will not interfere with the construction work undertaken by the petitioner in the schedule property and the allegations made in the present Writ Petition are baseless and it is for the parties to approach the competent Civil Court, if they so desire.
3. The statement made by the learned AGA is placed on record.
4. In view of the above, Sri S.M. Chandrashekar, learned senior counsel appearing for the petitioner submits that recording the said statement, the Writ Petition may be disposed off.
Accordingly, placing the statement made by the learned AGA on record, the Writ Petition is disposed off.
