Petitioner is the father of Sreelakshmi, a 2nd year Degree student in UIT College, Kuravankonam, Thiruvananthapuram. According to the petitioner, on 26.5.2014, his daughter left for the college as usual, but did not return to the house. Enquiries made by him revealed that she was abducted by a person by name Murugan whose whereabouts is in vain. Alleging that his daughter is being illegally detained by the aforesaid Murugan, he filed this Writ Petition with the prayer to issue a writ of habeas corpus and to set his daughter at liberty. By order dated 12.6.2014, the Writ Petition was admitted and the alleged detenue was ordered to be produced before us. Accordingly, she was produced before us today.

Learned Government Pleader reported that coming to know of the filing of the Writ Petition, the detenue and Murugan surrendered before the Vilappilsala Police Station and they were brought to Pothencode Police Station, where the crime was registered on the complaint made by the petitioner. It is stated W.P.(Crl) No.250/2014 2 that they were thereafter produced before the Judicial First Class Magistrate Court, Attingal and that as per the orders of the court, she was accommodated at Mahilamandiram, Poojappura.
3. On production of the detenue before us, we interacted with her and in answer to our questions, she stated that she voluntarily left with Murugan, with whom she was in love. She also produced certificate issued by the Kalavamkodam Puthukkattukunnel Sree Saktheeswara Kshethram, which shows that she and Murugan got married on 30.5.2014 in accordance with the customary rites.

Evidently, therefore, the detenue has not only denied the allegation of the petitioner that she is being illegally detained, but also the documents produced by her and the statement made in the Court show that she and Murugan are customarily married and are living as husband and wife. In such circumstances, this Court cannot entertain this Writ Petition.
Writ Petition is accordingly closed.
