In accordance with the Government Memo 7296/J2/2002-09, dt.15.10.2009 petitioner submitted application to start Multipurpose Health Workers(male) Training Institution. By way of communication vide letter No.297-490/MPHA/APPMB/2014, dt.18.09.2012 request of the petitioner was rejected on the ground that no such institution exists at the address given by the petitioner.
The learned counsel for the petitioner submits that no such institution exists in the premises was erroneous and on illegal ground the request of the petitioner to start institution was rejected. It is further submitted that for several other institutions second opportunity was afforded and if opportunity is given to the petitioner, he would satisfy the Para Medical Board the eligibility and suitability of the petitioner to start Multipurpose Health Workers(male) Training Institution and that institute exists with all the required criteria having been fulfilled. However, the learned counsel for the petitioner submits that so far as no further application is submitted by the petitioner requesting the respondents-Board to conduct reinspection of the premises and the petitioner would submit an application for reinspection of the college premises.
Since the order dt.15.09.2012 by which the request of the petitioner was rejected is not challenged and since so far no fresh application is submitted requesting the respondents-Board for conducting reinspection of the premises of the institute with reference to the compliance of the requirements for commencing a training institute, no mandamus as sought by the petitioner can be granted. However, since petitioner is now coming forward to submit an application requesting the respondent board to conduct reinspection of the institution premises, liberty is granted to the petitioner to submit such an application for reinspection and as and when such a representation is received, the A.P. Para Medical Board shall receive and conduct reinspection of the petitioner’s premises with reference to the parameters required to be fulfilled for starting an institution as proposed by the petitioner and take appropriate decision as per law and communicate the same to the petitioner. The entire exercise shall be completed within a period of six (06) weeks from the date of receipt of the application from the petitioner.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous Petitions pending if any, shall stand closed.
