The learned Standing Counsel takes notice for respondent Nos.1 and 2 and in the nature of the orders to be passed, the 3rd respondent is not served with notice. 2. I have heard the learned counsel for the petitioners as also the learned Standing counsel for the University.
3. The grievance of the petitioners is that, they are unable to attend the 3rd semester supplementary examination and 5th semester examination, for reason that the malpractice proceedings initiated against them as per Ext.P1, have not concluded.
4. The petitioners, if otherwise eligible, shall be permitted to appear for the 3rd semester supplementary examination as also the 5th semester examination W.P.(C) No. 29773 of 2014 (V) 2 provided that the petitioners have made applications and paid requisite fees in accordance with the rules of the University. The petitioners shall be issued with hall tickets provisionally and the result of the examinations shall be subject to the malpractice proceedings initiated by Ext.P1. It would be desirable that the University concludes the malpractice proceedings within a period of 'three months' from today.
5. It is made clear that, the publication of results shall be subject to the conclusion of the malpractice proceedings.
The writ petition is disposed of.
