JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition under Section 438 Cr.P.C. 2. Petitioner is the second accused in Crime No.793/2014 of Pulinkunnu Police Station registered for the offences punishable under Sections 323, 324 and 326 read with Section 34 IPC.
3. The allegation against the petitioner and other accused is that they attacked the de facto complainant and caused grievous hurt. It is specifically alleged that it was the petitioner who beat the de facto complainant with an iron rod, thereby causing fracture of his jaw bone and loosening of teeth.
4. Heard learned counsel for the petitioner and learned Public Prosecutor.
5. It seems that the learned Sessions Judge has BA.6810/2014 : 2 :
granted anticipatory bail to A1 and A3 as there were no allegations against them that they had made use of any weapon. At the same time, specific overt acts are alleged against the present petitioner, which reveal that it was he who has caused grievous hurt to the de facto complainant. The contents of the CD, prima facie, reveal the complicity of the petitioner. This is a case in which the custodial interrogation of the petitioner is required for the continued investigation. Matters being so, I am of the view that this is not a fit case wherein anticipatory bail can be granted to the petitioner.
In the result, this Bail Application is dismissed.
