JUDGMENT / ORDER

Accused Nos.3 and 5 in CC.No.298 of 2007 before the Chief Judicial Magistrate Court, Manjeri are the revision petitioners herein. Their application for discharge was disallowed by the learned Chief Judicial Magistrate as per Order in CMP.No.1119 of 2008 dated 12.3.2009. The said order is under challenge in this revision.
2. The revision petitioners or their counsel are not present in Court to make arguments in this revision. On the last posting date (20.05.2010) also there was no representation from the side of the revision petitioners. It appears that they are not interested in prosecuting this revision. Pendency of the main case cannot be indefinitely stayed in such circumstances. If the revision petitioners are not interested in prosecuting the revision, the only course possible is to dismiss it for default.

3. In the result, this revision is dismissed for non prosecution. Send a copy of this Order immediately to the trial court.
