JUDGMENT / ORDER

The petitioner herein is the sole accused in C.C.No.708/2012 of the Judicial First Class Magistrate Court, Kolencherry. The offences involved are under Sections 406 and 420 of the Indian Penal Code. In this proceeding brought under Section 482 of the Code of Criminal Procedure to quash the prosecution, the dispute was referred for mediation to the mediation centre attached to the High Court of Kerala. In the process of mediation, the parties came to terms amicably, and accordingly, a mediation agreement was signed. Now it is reported that the whole dispute stands settled, and that continuance of prosecution will not serve any purpose. I find that in the present circumstances continuance of prosecution will do injustice to both sides, and so the prosecution can be quashed as requested by both the parties. The defacto complainant has filed affidavit to the effect that he has no grievance or complaint now.
Crl.M.C No.1098 of 2013 2 In the result, this Criminal Miscellaneous Case is allowed. The prosecution pending against the petitioner herein in C.C. No.708/2012 before the Judicial First Class Magistrate Court, Kolencherry will stand quashed under Section 482 of the Code of Criminal Procedure, and the petitioner will stand released from prosecution.
