Respondents Petitions filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 praying to appoint an independent Arbitrator to arbitrate all the claims and disputes between the petitioner and the respondents arising out of the Agreement No.222/E/MAS dated 04.11.2003 and direct the respondents to pay the costs.

msr ORDER Heard Mr.Amalraj S.Penikilapatti, appearing for the petitioner and Mr.P.T.Ramkumar, appearing for the respondents.
2. Learned counsel Mr.P.T.Ramkumar appearing for the respondents would agree that the following two claims raised by the claimant are liable to be settled by the respondents as follows;
(i) Outstanding dues of a sum of Rs.89,398/-will be paid within a period of four weeks from date of receipt of this order.
(ii) Original Bank Guarantee No:4 of 2005 shall be returned to the petitioner within four weeks from date of receipt of this order.
3. Recording his undertaking as above, this Original Petition is closed. Liberty is granted to the petitioner to approach this Court in the event the above undertaking is not complied with. No costs.
