JUDGMENT / ORDER

This application has been preferred by the original respondent of Special Civil Application No.4520 of 1991 whereunder the present respondent was the petitioner.
Learned advocate for the applicant has invited attention to the judgment dated 20.4.2001 with special reference to the following sentence in paragraph No.9 of the judgment, "The respondent corporation is directed to grant all consequential benefits to the petitioner including promotional / posting as if the impugned order to the aforesaid extent with no order as to costs".
to submit that the grant of consequential benefit in relation to promotional / posting has to be subject to the petitioner fulfilling the necessary norms.
Learned advocate appearing for the original petitioner states that the petitioner has no objection to the aforesaid clarification subject to the petitioner being considered and given an opportunity in this regard.
The aforesaid sentence in paragraph No.9 of the judgment dated 20.4.2001 shall read as under:
"Respondent-Corporation is directed to grant all consequential benefits to the petitioner including promotional / posting, subject to fulfilling the requisite norms stipulated by relevant rules, regulations and instructions etc. as if the impugned order dated 2.7.1991 had never been passed. Rule made absolute with no order as to costs".
The application is accordingly allowed to the aforesaid extent. Rule made absolute.
