1. Rule.
Learned counsel Mr.M.T.Mishra, holding brief of Mr.T.R.Mishra waives service of notice of Rule on behalf of the respondents. This is an application for condonation of delay of 8 days in filing Letters Patent Appeal. Heard learned counsel for the parties.
2. Considering the contents of the application, it cannot be said that the delay caused in filing the Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing Letters Patent Appeal deserves to be condoned. Accordingly, the application is allowed. Delay is condoned. Rule is made absolute. List Letters Patent Appeal for admission on 7th March, 2012 to which Mr.M.T. Mishra has no objection.
