O R D E R:
Heard learned counsel for the petitioner and learned standing counsel for respondents 1 to 4.
2. This writ petition was filed challenging the inaction of respondents 1 to 4 in not taking appropriate proceedings against the 5th respondent for his high handed actions.
3. The petitioner is a private limited company and it falls within the jurisdiction of the 5th respondent. Initially they have applied for supply of power to the 5th respondent and the 5th respondent sanctioned power supply to the petitioner company. Thereafter, the 5th respondent, for the reasons best known to him, started disconnecting power supply for hours together at different points of time without any authority. When the petitioner sought reasons for disconnection of power supply, the 5th respondent demanded money. It also appears that Crime No.147 of 2010 dated 08.08.2010 was registered by Anakapalle Police Station at the instance of the wife of the 5th respondent against the Purchase Manager of the petitioner company. Thereafter certain disputes arose between the petitioner and the 5th respondent. In those circumstances, the present writ petition was filed.
4. A counter-affidavit is filed on behalf of respondents 1 to 4 stating that the writ petition was filed only due to personal grievance and rivalry between the petitioner and the 5th respondent. However, on a complaint received on 12.08.2010, the first respondent was conducting a domestic enquiry against the 5th respondent and the same was pending.
5. Learned counsel for the petitioner fairly submitted that in view of the domestic enquiry conducted against the 5th respondent, no further relief can be granted in the writ petition.
6. Recording the statement made by respondents 1 to 4 that the first respondent was conducting a domestic enquiry against the 5th respondent, this writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
