JUDGMENT / ORDER

[Order of the Court was made by M.VENUGOPAL, J.] It is represented on behalf of the Respondent/Contemnor that the Secretary to Government, Higher Education Department, Secretariat, Chennai-9 (Full Additional Charge), in his Letter (D)No.396, dated 01.12.2016, addressed to the Petitioner, had considered the claim of the Petitioner and passed necessary orders negativing the request of the Petitioner in regard to his promotion as 'Instructor'. As such, this Court is of the earnest opinion that the Petitioner is to assail the validity, correctness and legality of the impugned letter before the competent Forum, of course, in the manner known to law and in accordance with law. Viewed in that perspective, this Court closes the Contempt Petition.
2. Before parting with the case, this Court makes it abundantly quite clear that the closure of the present Contempt Petition will not preclude the Petitioner to assail the correctness, validity and legality of the impugned letter before the competent Forum as per law.
