COMMON PRAYER: Writ Petitions are filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records on the file of the respondent herein in Na.Ka.No.98/14-Thoo.Vu.Thi.Ku dated 30.12.2016 and quash the same as illegal, invalid and against Principles of Natural Justice and consequently direct the respondent to open the seal put on the godown buildings in Door Nos.2/89-2, 2/89-4 and 2/89-3, Thiruchendur Main Road, situated in Survey Nos.51/2A, 51/2A,4,5 and 51/2A 4,5 respectively, Mullakadu Village, Muthaiahpuram, Thoothukudi Corporation.
[Common Order of the Court was made by A.SELVAM, J.] These writ petitions have been filed under Article 226 of the Constitution of India praying to call for records relating to the orders dated 30.12.2016 passed in Na.Ka.No.98/14-Thoo.Vu.Thi.Ku by the respondent and quash the same, by way of issuing a writ of certiorarified mandamus.
2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for the respondent.
3.The learned counsel appearing for the petitioners has contended to the effect that after obtaining necessary permission from the concerned authority, the petitioners have constructed three godowns, but the respondent all of a sudden has passed the impugned orders dated 30.12.2016 and thereby locked all the godowns and after receipt of the notices dated 30.12.2016, the petitioners have given representations along with all relevant documents and under the said circumstances, these writ petitions have been filed for getting the relief sought therein.
4.The learned Additional Government Pleader appearing for the respondent has also contended to the effect that after issuance of notice dated 30.12.2016, the petitioner has given representations and subsequently they have been directed to submit relevant records and accordingly they submitted the same.
5.On the basis of the rival submissions made on either side, it is made clear that after receipt of notices dated 30.12.2016, the petitioners have given representations and subsequently submitted all relevant records and the matter is pending on the file of the respondent. Under the said circumstances, this Court is inclined to pass the following order.
6.In fine, the respondent is directed to dispose of the representations given by the petitioners on merits within a period of fifteen days. With the above observation, these writ petitions are disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
