Addl. District Judge, Family Court, Visakhapatnam pending MACMAMP. No. 10685 of 2000 under Section 5 of Limitation Act to condone the delay of 107 days in filing the MAMCMA(SR) No. 12749 of 2000 sought to be preferred to the High Court against the order of the Court of the V Addl. District Judge, Visakhapatnam in MOP No. 221, 614/98 Dt: 22/071999 The Court while directing issue of notice to the Respondents herein to show cause why this application should not be complied with, made the following order. (The receipt of this order will be deemed to be the receipt of notice in the case).
ORDER :
“ There shall be interim stay, on condition that the petitioner deposits half of the amount awarded by the Tribunal, together with costs and interest, within a period of six (6) weeks from today. The amount deposited under section 173 of the Motor Vehicles Act shall also be taken into account.
On such deposit, the 1st respondent – claimant shall be entitled to withdraw the same, without furnishing any security.
