S.P.Sainaba Aged 48 Years vs State Of Kerala

High Court Of Kerala|31 January, 1998

JUDGMENT / ORDER

The petitioner who is working as Casual Sweeper under the fourth respondent Panchayat is aggrieved by the non-consideration of her request for regularization in service. It is the contention of the petitioner that her application for regularization is not being forwarded for appropriate consideration by the Government by the fourth respondent. However, the learned counsel appearing for the fourth respondent submitted that it was duly forwarded to the third respondent for the purpose of forwarding it to the first respondent for taking appropriate decision in the matter. The contention of the petitioner is that in the light of Ext.P7 she is entitled to seek for regularization. I am of the view that it is a matter to be considered ultimately by the first respondent. In the said circumstances, this writ petition is disposed of directing respondents 2 and 3 to forward the application for regularization submitted by the petitioner along with the remarks, if any, made by the fourth respondent and if not already forwarded, within a period of three weeks from the date of receipt of copy of this judgment to the first respondent. On receipt of the same, WP(C).No.19914/2012 2 appropriate orders shall be passed by the first respondent in accordance with law, at any rate, within a period of three months.
