S.Prakash Chand Jain vs C.Vijayaraj Kumar

Madras High Court|05 October, 2017

JUDGMENT / ORDER

(Order of the Court was made by The Hon'ble Chief Justice) This application for contempt is for the alleged violation of an order dated 9th January 2017 disposing of the writ petition filed by the petitioner, being W.P.No.542 of 2017, by directing that the representation of the petitioner dated 12th September 2016 be disposed of by the second respondent in accordance with law.
2. It is true that there was a direction to dispose of the representation within a maximum period of three months from the date of receipt of the copy of the order. It appears that the certified copy of the order was available on 17th May 2017. This is evident from the dates at the back of the certified copy.
3. It appears that the representation of the petitioner has been considered and disposed of by the respondent and the decision communicated to the petitioner by a letter dated 26th September 2017. There might have been some delay in compliance of the order. The delay, if any, is excused.
4. The contempt proceedings are closed. This order will not however prevent the petitioner from initiating such appropriate proceedings in accordance with law as the petitioner may be advised.
