The present application has been filed by the applicants for bringing the heirs of the respondent no.1 on record on the grounds stated in the application.
Heard learned AGP Mr.Dave for the applicants-State.
The opponent no.1 has expired and his heirs are sought to be brought on record as stated in the application as opponent nos.1/1 to 1/3, who are served. Therefore, considering the fact that the opponent nos.1/1 to 1/3, who are the legal heirs of the opponent no.1 would have the interest in the outcome of the litigation and, therefore, they are required to be brought on record.
Accordingly, the present application stands allowed in terms of Para No.6B permitting the applicants to bring on record the heirs of the deceased, opponent no.1, who are shown as opponent nos.1/1 to 1/3. Learned AGP is directed to carry out the amount in the cause title of main First Appeal. Rule is made absolute.
