JUDGMENT / ORDER

The present application has been filed under Rule 22 Rule (4) of the Civil Procedure Code for bringing the heirs of the respondent no.1 on record on the grounds stated in the application.
Heard learned AGP Mr.Banaji for the applicants-State. Though served, the proposed heirs have not remained present nor any one appeared.
In view of the averments made in the application, the opponents, who has expired, are required to be represented by the legal heirs as they will have interest in the outcome of the litigation. Therefore, the present application deserves to be allowed.
Accordingly, the present application stands allowed in terms of Para No.6B permitting the applicants to bring on record the heirs of the deceased, opponent no.1, who are shown as opponent nos.1/1 to 1/3. Learned AGP is directed to carry out the amount in the cause title of main First Appeal. Rule is made absolute.
