Mr. A.J.Patel learned advocate for the respondent waives service of notice of rule.
The respondent, in this application, has passed away. We have permitted his heirs to be brought on record by passing separate order. Learned advocate, Mr. Patel has appeared for the heirs of the original respondent. This application is for delay of 656 days in filing the first appeal.
Considering the contents of the application, we are satisfied that the applicants have made out sufficient cause for condonation of delay.
We, therefore, allow this application condoning delay of 656 days in filing the first appeal. Civil application stands disposed of. Rule is made absolute accordingly.
