1. Pursuant to the order dated 16.02.2012, passed in this application, as stated by the learned AGP, entire amount awarded by the Reference Court together with costs and interest has already been deposited.
2. In response to the rule issued by this Court, respondent No.1-Nagjibhai Shankerlal, is personally present today. So far as respondent No.3 is concerned, he is already served, but, nobody appears on his behalf. Since, the amount has already been deposited, we allow respondent Nos. 1 and 3-the claimants to withdraw FIFTY per cent of the amount deposited by the applicants. So far as remaining 50 per cent amount is concerned, same shall be invested in Fixed Deposit Receipts, initially, for a period of FIVE YEARS and the same shall be RENEWED from time to time, till the disposal of the first appeal.
3. The stay granted earlier is, hereby, CONFIRMED. Rule is made absolute, accordingly.
