[1] The present applications have been filed by the applicant for restoration of the main matters being First Appeal (Stamp) Nos.1986 to 2001 of 2010 which have been dismissed for non-prosecution by the Court [Coram: S. R. Brahmbhatt, J.] vide order dated 12.10.2010.
[2] Heard learned advocate Mr.Chirag Patel for the applicant and learned AGP Ms.Trusha Mehta for the respondent No.1.
[3] Learned advocate for the applicant has submitted that in fact the office objections have been removed before passing the order and, therefore, in the interest of justice, the said order is required to be recalled.
[4] In the facts and circumstances of the case and in the interest of justice, the applications are allowed. The order passed by the Court [Coram: S. R. Brahmbhatt, J.] dated 12.10.2010 is hereby recalled. The prayer in terms of paragraph No.5(B) is granted. The main First Appeals are ordered to be restored to file.
[5] Office is directed to place the main First Appeals for admission hearing on 13th April 2012.
