(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned counsel appearing on both sides in all these matters jointly submitted that previous order dated 17.8.2012 had come to be made under the impression that Special Civil Application No.4564 to 4567 of 2012 were challenging vires of some provisions of the Gujarat Provincial Municipal Corporations Act, 2011, whereas admittedly none of the petitions is challenging vires of any provision of any Act. It was further submitted that, in fact, in each of the petition, the prayers were for setting aside demand of property tax under the aforesaid Act, and therefore, the petitions were really required to be listed before the Division Bench taking up taxation matters, as per the current roster. It was on that basis submitted that the matters may once more be placed before Honourable the Chief Justice for appropriate orders for listing of the matters before appropriate Court. The office shall do the needful. Till the matters are listed again before appropriate Court, interim relief granted earlier in Special Civil Application Nos.4564 to 4567 of 2012 shall continue to operate.
