All these applications are filed for condonation of delay of 342 days caused in filing respective First Appeals.
Heard learned AGP, Mr.P.P.Banaji for the applicants. It is stated by Mr.Banaji that notice is duly served on the respondents in Civil Application Nos.6436/2010, 6438/2010, 6439/2010, 6440/2010, 6445/2010 and 6448/2010.
This Court has gone through the above numbered Civil Applications. In view of the fact that the reasons stated in these application have not been controverted by the otherside by filing affidavit and also in view of the principles governing the discretionary exercise of power under Sec.5 of the Limitation Act, 1963, I am of the view that sufficient cause has been stated for not filing the appeals in time and hence, delay caused in filing appeals is condoned and Civil Application Nos.6436/2010, 6438/2010, 6439/2010, 6440/2010, 6445/2010 and 6448/2010 are allowed.
In view of the fact notice is not duly served on the respondents in Civil Application Nos.6441/2010, 6444/2010 and 6446/2010, these applications stand adjourned to 11-7-2012 awaiting service of notice.
