The present First Appeals have been filed under Section 54 of the Land Acquisition Act, 1894 read with Section 96 of the Civil Procedure Code, 1908 by the appellants-State being aggrieved and dissatisfied with the judgment and award rendered in Land Reference Case Nos.222 to 228 of 1998 by the Learned Additional District Judge, Fast Track Court No.2, Bharuch dated 30.11.2009 awarding additional compensation at the rate of Rs.36.50 per sq.mtrs.
Heard learned AGP Mr.Devang Dave for the appellants-State and learned counsel, Mr.K.M. Sheth for the respondents-original claimants.
The present First Appeals deserve to be dismissed only on the count of smallness of the claim without entering into the merits as the claim is less than Rs.1.00 lacs. Accordingly, the present First Appeals stand dismissed.
