The present civil applications have been filed under sec. 5 of the Limitation Act for condonation of delay of 1025 days caused in ffiling the First Appeals on the grounds stated in the memo of applications particularly that time was consumed in the process of getting necessary approval.
2. Heard learned AGP Mr. Banaji for the applicants as well as learned advocate Mr. M.M. Saiyed for the respondent-original claimant.
3. In the facts and circumstances and in view of the guidelines laid down by the Hon'ble Apex Court in the judgments reported in AIR 2000 SC 2306 and AIR 1996 SC 1623 regarding pragmatic approach to be taken in such cases, the present civil applications deserve to be allowed.
The applications are allowed. Prayer in terms of para 7(a) is granted. Delay is condoned. Rule is made absolute.
The First Appeals to be placed on board on 30.1.2012. Name of learned advocate Mr. M.M. Saiyed may be shown for the respondent-claimant.
