The present civil application has been filed for condonation of delay caused in filing the First Appeal under sec. 5 of the Limitation Act on the grounds stated in the application inter alia procedural delay in getting necessary approval/sanction after completing the formalities.
Heard learned AGP Mr.Banaji for the appellants. Though served, non appeared for the respondents.
In the circumstances and in view of the grounds mentioned for explaining the delay, sufficient cause is made out for condonation of the delay. It is well settled that the Hon'ble Apex Court has laid down the guidelines with regard to the approach in such mattters of condonation of delay. Therefore, in view f the observations of the Hon'ble Apex Court in the judgments reported in (2005) 3 SCC 752, AIR 2000 SC 2306 and AIR 1996 SC 1623, the present civil application deserves to be allowed.
The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
