Heard Mr.AC Choksi, learned advocate for the applicant - Special Investigation Team (SIT), Mr.Pravin Gondaliya, learned advocate for opponents No.1 and 2 and Mr.JM Panchal, learned Special Public Prosecutor for opponent No.3 - State. Learned counsel representing the parties stated that so far as the main matter being Special Criminal Application No.761 of 2011, now the cause for that main matter does not survive and that matter deserves to be withdrawn and accordingly, it may be disposed of.
In view of the above submission, the instant application preferred for preponing the date of the main matter, deserves to be allowed, as the learned counsel representing the parties have no objection.
In the above view of the matter, the instant application is allowed and the main matter being Special Criminal Application No.761 of 2011 is ordered to be taken on board today. Registry to act accordingly.
