Special Tahsildar vs Chinnaveeran

Madras High Court|07 June, 2017

JUDGMENT / ORDER

The Special Tahsildar, Land Acquisition, South Neighbourhood Scheme, Unit III, Madurai has filed the present applicationS seeking to condone the delay of 215 days in filing AS.SR.Nos.27547, 27549, 27551, 27553 of 1996.
2.Heard the Learned Government Advocate, Mr.R.Vel Murugan for the petitioner/appellant.
3.There are four Civil Miscellaneous Petitions. All the Civil Miscellaneous Petitions arise from Land acquisition proceedings. They arise from the Judgment dated 30.11.1994 and the award was dated 15.10.1991. It is seen from the affidavit that a copy of the judgment was received on 20.06.1995. Thereafter with the delay of 215 days, the appeals have been presented. It is seen that the reasons for the delay, the deponent of the affidavit has stated that the Local Government Pleader had forwarded the judgment for opinion of the petitioner/appellant. It is stated that there was a delay of 134 days in forwarding the certified copy of the judgment along with the opinion. Even thereafter, there is a further delay of 90 days. The delay has not been explained properly. It is clear that the appeals have been filed as a formality . The amount had been deposited to the credit of the LEOPs and also withdrawn by the claimants.
4.Consequently, the C.M.P.Nos.1347, 1348, 1349 and 1350 of 1998 petitions are dismissed and the appeals are rejected at the SR stage itself. No costs.
