JUDGMENT / ORDER

The C.M.P.No.10314 of 1997 has been filed in C.M.P.No.6444 of 1995 which has been filed in C.M.P.No.8567 of 1990 which has been filed in A.S.SR.No.91145 of 1988. It is seen from the above, there has been a delay in filing the appeal. 2.The C.M.P.No.8567 of 1990 has been filed to condone the delay in filing the appeal in the affidavit which is under consideration. The number of days delay in the filing the appeal is not given. C.M.P.No. 8567 of 1990 was dismissed for default. There after another C.M.P.No.6444 of 1995 was filed to restore the same, that was also dismissed. The present application is to restore the said Civil Miscellaneous Petition. The only reason given is that there was heavy work in the office of the deponent of the affidavit namely, the Special Tahsildar, Aruppukottai. The reason cannot be accepted by this Court as every office there is owing to be heavy work. It is also seen that the respondents have died and legal representatives were not brought on record. On that ground also, these Civil Miscellaneous Petition were dismissed earlier. I find no reason in allowing the present petition.
3.According to the reasons stated above the C.M.P. No.10314 of 1997 is dismissed. No costs. Accordingly, connected A.S.No.SR91145 of 1997 is rejected, at the S.R stage itself.
