Even no due certificate was issued by the Bank of Baroda on 15/12/2008 and subjecting the petitioner to rigour of trial would unnecessarily cause hardship. The learned Advocate for the Petitioner has placed reliance on decision of [i] Nikhil Merchant v. Central Bureau of Investigation and another, [2008] 9 SCC 677 and [ii] Madan Mohan Abbot v. State of Punjab, [ 2008] 4 SCC 582.
In view of the above, Notice returnable on 22/06/2012.
In the meanwhile however the proceedings of the case impugned in this Petition shall remain status-quo.
