JUDGMENT / ORDER

The petitioner has approached this Court with a prayer that show cause notice dated 16th March, 2002 be quashed and set-aside.
In my opinion, the petition is premature and, therefore, it should not be entertained. However, looking to the fact that allegations with regard to political mal fides have been levelled and looking to the peculiar facts of the case, it is directed that if ultimately, in pursuance of the said show cause, after hearing the petitioner, an order for removal of the petitioner is passed under Section 76 - B of the Co-operative Societies Act, the order which might be passed shall not be implemented for a period of two weeks from the communication of the said order of the petitioner. Needless to say that the concerned authority shall act impartially and fairly while deciding the matter.
In pursuance of this direction, learned advocate Shri Ketan D. Shah seeks permission to withdraw this petition. Permission for withdrawal is granted. Petition stands disposed of as withdrawn.
