JUDGMENT / ORDER

In pursuance of the notice of this Court, it is submitted on behalf of respondent No.3 that at present, the proceedings are only at the show cause notice stage and enquiry under Section 7A of the Employees Provident Fund and Miscellaneous Provision Act, 1952 is going on Mr. Mehta states that till the enquiry is concluded no proceedings will be taken against the petitioner.
In the aforesaid view of the matter, it is clear that the present petition is at a premature stage. it would be open for the petitioner to point out before the Authority whatever contations which the petitioner wants to reply.
This petition cannot be entertained at this stage when only notice has been given to the petitioner in connection with the enquiry under section 7A of the Act. This petition is not maintainable at this stage and it is accordingly rejected.
Notice is discharged.
No costs.
It will be open for the petitioner to take all available contentions in the enquiry which is pending with the respondent No.3.
