1.Heard learned counsel Mr. Hasim Qureshi for petitioner and learned counsel Mr. M.D. Pandya for respondent Gujarat Electricity Board, on caveat. Caveat stands disposed of.
2.Upon consideration of the matter, following directions are issued:-
2.1The petitioner do pay the remaining sum outstanding of the supplementary bill, as revised as per the order of the Appellate Committee (Annexure-B) to the petition in four equal monthly installments, the last installment shall include the delayed payment charges. The first installment shall be paid on/or before 6th August 2001, and remaining installments shall be paid on/or before 6th of succeeding English calendar months.
2.2Petitioner to undertake not to alienate assets of the petitioner or transfer possession thereof to third party, except the goods in common course of business,till all the electricity dues are paid to the respondent Board.
2.3Petitioner to continue to pay current consumption charges and abide by conditions of supply.
3.Petitioner will be at liberty to represent to the appellate committee his grievance about calculation mistake as alleged, regarding application of the formula governing the theft case. The payment made or to be made as per this order will be subject to decision of the appellate committee on the said representation.
4.The petitioner shall file undertaking within one week hereof to abide by the terms hereof. Upon failure to abide by any of the terms hereof the power supply shall be liable to be disconnected without further notice.
5.In view of above, no further relief is sought and the petition stands disposed of accordingly. I make no order as to costs.
