Mr.Mehta, after arguing this matter for some time, has requested the Court to allow him to withdraw the petition, since the petitioner would like to make a representation, as according to him, unfortunately, no reply was filed to the show cause notice issued to him by the respondent Corporation. Mr. Mehta therefore, wants to withdraw this petition in order to make representation. Permission to withdraw this petition is granted. It will be open for the petitioner to make representation to the Corporation on all available points and if any such representation is made, the Corporation may decide the same in accordance with law. It is needless to say that whatever points are taken in the representation also will be taken care of while taking decision on such representation by the Authority. It is clarified that this court has not expressed any opinion on the issue involved in the petition. It is for the corporation to take decision on the representation of the petitioner in accordance with law. Since the petitioner could not give reply and it is the submission of the petitioner that the petitioner wants to produce some evidence, he is permitted to make representation, and it is for the corporation to take appropriate decision in accordance with law and as per the evidence available on record. it is however clarified that if the decision on the representation is against the petitioner it will be open for the petitioner to take further recourse in accordance with law. The petition is accordingly disposed of. Notice is discharged with no order as to costs.
Mr. Mehta states that the representation will be made on or before 10th April, 2002. if such representation is made by that date, the corporation may decide expeditiously within a period of two months from the date of receipt of the representation.
