Jasuben Nanjibhai, petitioner, has filed this petition against the Gujarat State Road Transport Corporation praying for an appropriate writ, order or direction quashing and setting aside the impugned decision dated 26.12.2000 as confirmed in Regular Civil Appeal No.1 of 2001 by the District Court and further prayed that the respondents be directed to permit the petitioner to place her Lorry at the same place within the premises of the Limdi Bus Station as a fixed stand, which was in existence prior to the date of passing of the order dated 26.12.2000.
When the matter was placed for hearing before this Court, on 30.4.2001 this Court (Coram: Kundan Singh, J.) has passed the following order:
"No show-cause-notice has been issued by the respondents before cancelling lease which is valid upto 31.8.2001. Notice returnable on 4.5.2001. D.S. is permitted."
Thereafter on 4.5.2001 this Court (Coram: Kundan Singh, J.) has passed the following order:
"Mr.A.M.Dagli for Mr.Y.S.Lakhani, learned Counsel appears on behalf of the respondents. He prays for and is granted five weeks' time to file an affidavit-in-reply. List this matter on 27.6.2001. The respondents shall not restrain the petitioner from carrying on business of selling cold drinking water at the same place within the Limdi Bus Stand as per the terms of the contract dated 31.7.2000 till then. D.S. is permitted."
Thereafter again this Court passed further orders on 27.6.2001 which reads as under:
"When the matter was placed before this Court on 30.4.2001, this Court has issued notice and the learned counsel for the respondent has also given time for filing affidavit but till today no affidavit has been filed. In view of the same, with a view to see that the respondent authority may consider the contention raised by the petitioner sympathetically and kindly, the Court further grants time upto 11th July, 2001. S.O. to 11th July, 2001. Interim relief granted earlier to continue till then. D.S. is permitted today."
Thereafter again this Court passed further orders on 11.7.2001 and 13.7.2001, still the Corporation has not filed affidavit in this behalf.
In view of the same, Rule returnable on 7th August, 2001. Interim relief granted earlier to continue till further orders.
