JUDGMENT / ORDER

1. In present application, the applicant has prayed for below mentioned relief:
"4(A) YOUR LORDSHIPS may be pleased to allow this Civil Application and may be pleased to permit the applicant to withdraw the writ petition being Special Civil Application/21067/2006 from this Hon'ble Court with a view to avail the benefit of "Amnesty Scheme" of Government of Gujarat."
2. Though present Civil Application has been listed in today's cause list (at Sr. No.50), the petition i.e. Special Civil Application No.21067 of 2006 (with reference to which the request is made in present application) is not listed. Therefore, in view of the request by learned advocate in the first session, the registry was directed to include, in today's cause list, the main matter. Accordingly Special Civil Application No.21067 of 2006 is listed in separate cause list.
3. Learned advocate Mr. Kuntal Joshi appearing for learned advocate Mr. Majmudar appearing for the applicant has submitted that his client i.e. applicant/original petitioner has instructed him (i.e. learned advocate for the petitioner) to withdraw the petition because the petitioner intends to approach the electricity company in response to the Amnesty Scheme launched by the company.
4. Learned advocate for respondent has no objection if the request for withdrawal of main petition is accepted and granted. Therefore, below mentioned order is passed:
5. The relief prayed for by the applicant in present application in para-4(A) for withdrawal of petition is granted. The applicant is permitted to withdraw Special Civil Application No.21067 of 2006. Present application stands disposed of.
