S.Pandi vs Mr.Balakrishnasamy

Madras High Court|05 June, 2017

JUDGMENT / ORDER

This contempt petition filed against the Contemnors/Respondents and punish them for the willful disobedience of the order of this Court in W.P.(MD)No. 7112 of 2016 dated 12.04.2016 which read as follows:
?Taking into account the narrow prayer made by the petitioner in the Writ Petition to dispose of his representation dated 29.02.2016 which relates to granting of 4th and 5th Review Benefits and Pay Revision and Pension Revision in the light of the Go.Ms.No.61 Transport (C) Department dated 30.04.2015 and in terms of settlement dated 22.01.2011 entered into Section 12 (3) of the Industrial Disputes Act, the Writ Petition is disposed of directing the second and third respondents to pass orders on the representation of the petitioner dated 29.02.2016 in the light of the Go.MS.No.61 Transport (C) Department dated 30.04.2015 and in terms of settlement dated 22.01.2011 entered into Under Section (12)3 of Industrial Disputes Act, Within a period of twelve weeks from the date of receipt of a copy of this order. No Costs."
2. The Managing Director, The Tamil Nadu State Transport Corporation Ltd, considered the representation and passed final orders stating that the petitioner is entitled to the relief made for. The grievance of the petitioner is that the actual relief and other benefits to the petitioner are not granted. Hence the respondents have committed contempt. Having regard to the nature of order passed by this Court, this Court finds that the direction of this Court was only to consider the representation of the petitioner in terms of settlement dated 22.01.2011 and to pass order.
3. Since the respondent has passed appropriate orders on the representation of the petitioner, there is no violation or disobedience. This contempt petition is dismissed.
