Spandan vs Appearance

High Court Of Gujarat|02 May, 2012

JUDGMENT / ORDER

This application has been filed by the applicants (original petitioners) with a prayer to prepone the date of hearing of Special Civil Application No.15487 of 2011. The said petition had been directed to be listed for hearing on 25.06.2012.
Heard Mr.Keyur Gandhi, learned advocate for M/s.Nanavati Associates, learned counsel for the applicants, Ms.Nisha M.Thakore, learned Assistant Government Pleader for opponents Nos.1 and 2 and Mr.Arpit Patel, learned advocate for Mr.Mukesh Patel, learned advocate for opponent No.3.
It is submitted by the learned advocate for the applicants that the urgency on the part of the applicants is that they have already made payment of rupees ten crores approximately but the opponent-Railways are not granting possession of the land in question. Moreover, the land is a huge parcel of land and delay in the matter would result in delay in development thereof. Therefore, the date fixed for listing of the petition be preponed.
As there is no opposition to the prayer made for preponement of the date by the learned counsel for the opponents, the following order is passed:
Special Civil Application No.15487 of 2011 be listed on 10.05.2012.
The application is disposed of.
