JUDGMENT / ORDER

The matter has been amicably settled in mediation. A mediation settlement agreement has been prepared and produced. The learned Receiver has prepared the compromise petition along with the other parties. All the terms and conditions contained in the mediation settlement agreement are lawful and can be upheld. As per the mediation settlement agreement, the judgment and decree passed by the Subordinate Judges' Court, Mavelikkara have to be set aside.
2. In the result, the mediation settlement agreement and the compromise petition are accepted and recorded. This appeal is decreed in terms of mediation settlement agreement and compromise which have to be appended with the decree. The same shall form part of the decree. The judgment and decree of the Subordinate Judges' Court, Mavelikkara in O.S. No.69/1975 are set aside.

A.S. No. 332 of 2000 The court fee shall be refunded to the appellant. The appeal is disposed of accordingly.
