JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE DAMA SESHADRI NAIDU WRIT PETITION Nos.15565 of 2007 and 2072 of 2009 COMMON ORDER:
This sordid saga does not seem to have an end. On 20.03.2014 and on 07.04.2014 this Court passed detailed docket orders concerning the unseemly row between the petitioner and his own counsel, rather than the respondents. On both the occasions, the petitioner appeared separately and represented that he did not desire to continue the writ petitions. The learned counsel for the petitioner, on both the occasions, represented to the Court, appearing at some other time of the day, that the petitioner never met him, much less instructed him to withdraw the writ petitions. He has further added that the respondent authorities are pressurizing the petitioner, his credulous client, to withdraw the writ petitions, having committed irregularities.
Yet again, this day, the petitioner is present in person and the learned counsel, who earlier represented him, is absent. The learned Standing Counsel, on his part, produced before this Court what is said to be the representation of the petitioner, dated 09.03.2009, addressed to the Executive Officer of 1st respondent temple informing that he had voluntarily decided to withdraw the writ petitions in question. Accordingly, the petitioner has also requested the authorities to settle all the benefits due to him from 10.01.2008.
Though on earlier occasion, the learned counsel for the petitioner has insisted that this Court would not dispense with his services vis-à-vis the petitioner unless there is a strict observance with the procedure in terms of the Advocates Act, this Court observes that the petitioner has consistently appeared before this Court and has expressed his willingness to withdraw both the writ petitions. The learned counsel for the petitioner has not, however, stated that he has any other serious reservations about the petitioner’s withdrawing the writ petitions.
Having been satisfied with the identity of the petitioner, this Court is of the considered opinion that the request of the petitioner shall be acceded to.
Accordingly, both the writ petitions are dismissed as withdrawn. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
